The General Terms and Conditions of Sale

We invite Users to read carefully and consider the provisions of this general terms and conditions of sale because by use of the website and by placing and confirming an order, the User agrees to be bound by the provisions of this terms and Conditions. These terms have been made in full compliance with the provisions of the Consumer Protection Council Act and The Standard Organisation of Nigeria Act including the regulations made by the above mentioned regulatory bodies and it constitutes the entirety of the contractual relationship between Theshowroomng.com and every user.
By visiting this website, the User agrees that he/she has attained the age of 18 years or is accessing the Site under the supervision of a parent or guardian.

1. Formation and Conclusion of Contract: The display and advertisement of products on the Site does not constitute an offer for sale for a mere invitation to treat. An offer for sale is made when the Customer selects or chooses an item and placing an order. After placing the order, the Customer confirms the order, and the transaction is concluded as soon as Theshowroomng.com records the order and verifies the correctness of the data relating to the order and payment.

2. Ownership and Accessibility of Website: The website is owned by Theshowroomng.com, including any intellectual property rights attached to it. The website is acceptable to anyone regardless of whether or not they have registered on the site. Registration is however recommended to improve the shopping experience of the Customer and give the Customer access to promotional offers.

3. Acceptance of Electronic Documents: The Customer accepts the receipt of electronic documents and the electronic documents will satisfy any legal provision requiring the document to be in writing.

4. Payment and Pricing: All prices by Theshowroomng.com are shown in the Nigerian Naira and it includes the chargeable VAT on the ordered item. The Price does not include the shipping fee which will be charged separately.
The Customer undertakes to pay the purchase price and shipping cost which appears on the Site and using available payment methods.
Property in the products is not transferred until payment has been received by Theshowroomng.com. In the event that Theshowroomng.com does not receive payment at all or complete payment, it reserves the right to cancel the order, and where part payment has been made, Theshowroomng.com will refund the amount transferred to it. Payment on the site can be made using a credit card, debit card, and bank transfer. Payment is not complete until Theshowroomng.com has received the specified amount and verified the transaction.

5. Delivery/Shipping: All freight is delivered to the street level of the requested delivery address. A customer signature is required.
Shipping costs are charged separately from the cost of the items and communicated to the customer at the time of confirmation of the order and will depend on the location and type of item purchased by the Customer.
The time of delivery will be determined by our 3rd party courier partners, this will vary depending on the delivery location. The time of purchase verification and availability of the products may also determine a delivery time.
The delivery time quoted in the purchase order is subject to change and does not bind Theshowroomng.com.
If the time of delivery is of the essence to the Customer, he/she is advised to look at the product data to determine the average availability of the product and thereafter contact the Customer care line of Theshowroomng.com to ensure efficient delivery with our partner third party Logistics Company who undertakes delivery to the Customer’s address.
If the customer makes an order for “personalized” products, the times of dispatch and delivery may vary in relation to the craftsman production process that will be put in place. In any case, where an unexpected result occurs that can slow down the fulfillment of an order, Theshowroomng.com will promptly inform the customer in order to come to the best delivery solution.
Upon receipt of the delivered goods, the Customer must check the goods to ensure that they fit the description of the goods ordered by them. If any defect is found, the customer must promptly report by sending an e-mail to sales@cosmodesign.net or by calling the customer care line and following the instructions of the Customer care personnel.
If the purchased goods cannot be delivered either because the wrong address was filled out by the Customer or for any other reason being the fault of the Customer, the delivery person will drop a card at the provided address to certify that an attempt has been made to deliver the goods. The goods would then be returned to Theshowroomng for storage. The Customer is liable to pay for storage for the duration of time that the product remains in storage at Theshowroomng.com.

6. Return Policy: At theshowroom, we want our customers always to have an enjoyable experience, from your first glimpse at our online store to when you enter the store, all the way until you finalize your purchase. If you’re not happy with your purchase, we will do our best to make things right, which is why we offer a comprehensive exchange or return program for the first 7 days after delivery.
We ask you to familiarize yourself with the policy before completing your order.

 

UNDAMAGED / NON-DEFECTIVE PRODUCT
• Any undamaged In-Stock Merchandise and back ordered merchandise received by Purchaser purchased on Theshowroomng.com may be returned for store credit only, if TheShowroomng.com receives notice of such return within 4 days of Purchaser’s receipt of such merchandise.
• If merchandise is not returned within 7 days of TheShowroomng.com receipt of such notice, a fee of 25% of the purchase price for such merchandise will be deducted from Purchaser’s credit.
• Any product not received by TheShowroomng.com within 14 days will not be accepted for return.
• For items that were delivered correctly or were not defective upon Purchaser’s receipt (including items originally shipped or delivered for free), Purchaser is responsible for all shipping and delivery charges to return the merchandise to TheShowroomng.com office address.
• If TheShowroomng.com arranges the return, the shipper will bill TheShowroomng.com and that amount will be deducted from the amount credited to Purchaser. Items to be returned must be unused, unassembled and in their original packaging with all instructions and inserts. Once the product is received and our shipping department confirms it is in as-new condition, the purchase price of the item(s) will be refunded as a store credit less original shipping costs.
• There shall be no refunds/store credits for merchandise delivered in good condition to Purchaser, but returned damaged.
• It is advisable to avoid tapes and labels on the original product.
• Returns may be subject to a restocking fee of 25% if not returned in a timely manner.
• Within 2 business days of notifying TheShowroomng.com, the Purchaser will receive an email with the return shipping instructions for the item(s) and a Return Authorization (RA) number.
• Buyers are responsible for making a freight claim should damage be incurred during the returns process.

DEFECTIVE MERCHANDISE
Non-Shipping Related Defects
Customers who purchase goods on TheShowroomng.com that arrives with no shipping damage but that is found defective in manufacture or quality, must call the customer care line within 48hrs of receipt, and send photographic evidence to the store e-mail at sales@cosmodesign.net. Once we receive the email and confirm the defect, we will send an authorization number with instructions, which will be attached to the goods when returned. TheShowroom upon receipt of the defected goods and verification of the existence of the alleged defect, Theshowroomng.com will send the customer free of charge the replacement product as soon as possible to the shipping address entered during purchase. In the case of product unavailability, TheShowroom shall offer a full refund through the same method used for the purchase.
Shipping and Freight Damage
Purchaser shall inspect all packages before signing the delivery ticket. If Purchaser feels merchandise is defective upon receipt, he must:
1. Note on the freight company delivery receipt “Damaged” with a description of the piece
2. Notify the TheShowroomng.com within 24 hours of receipt
3. Keep all packing material for inspection
4. Take digital photographs of the damaged item and packing material
After the buyer takes these steps, TheShowroomng.com will file a freight claim with the shipper and arrange for repair or send a replacement subject to availability. Returns should be packaged carefully. Buyers are responsible for making a freight claim should damage be incurred during the returns process.

NON-REFUNDABLE / FINAL SALE ITEMS
All items purchased from our clearance section or Items marked as Final Sale or Floor Samples cannot be returned. Also sealed goods marked as “Non Returnable” due to hygienic reasons e.g. pillows, mattresses, bedding items e.t.c, cannot be returned.
If your item(s) arrive with damage due to shipping, report the damage following these steps:
1. Note on the freight company delivery receipt “Damaged” with description of the piece
2. Notify the TheShowroomng.com within 24 hours of receipt
3. Keep all packing material for inspection
4. Take digital photographs of the damaged item and packing material

7. Fittings/Assembly of Purchased Items: The services offered by Theshowroomng.com does not include assembly or fitting of the purchased goods, we only deliver to street level. Theshowroomng.com may, at its discretion, undertake installation and assembly of the purchased products through its professionals at an extra cost determined by theshowroomng.com.
The store will not be responsible for any damage to the fixtures or any part of the house not including the delivered goods that may have arisen during the course of installation and fitting.

8. Use of Voucher Codes: Theshowroomng.com may issue voucher codes to customers for their patronage and the validity of the voucher will be communicated to the customer. If the amount of things purchased is less than the amount in the voucher code, the Customer will be entitled to use the balance in the code in a subsequent transaction. The code cannot be exchanged or redeemed with cash. Products purchased with a voucher code are subject to the general terms and conditions.

9. Store Pick Up: The Customer may pick up items ordered online at any of the branches, by selecting the option before confirmation of the order. The items must be picked up within 5 days of confirmation and verification of the order.

10. Indemnity: The Customer agrees to indemnify and hold theshowroomng.com, their agents and privies harmless against any liabilities, damages, loss, claims and/or proceedings they may suffer and/or costs they may incur from defending any claims brought by the Customer or anyone acting on behalf of the Customer in respect of these terms and conditions.

11. Applicable Law and Jurisdiction: The law applicable to these terms and conditions is Nigerian Law applicable at the time of completion of the transaction.

12. Severability: The various articles of these terms and conditions are separate and separable and the declaration of any part as unlawful by a duly constituted court does not invalidate the entire provisions of these terms and conditions.

13. Termination: A Purchase order may only be terminated in accordance with the provisions of the General Terms and Conditions of Sale.

14. Product Warranty: Theshowroomng.com together with partner manufacturers guarantees to the Customer that the product is in good condition and fit for the purpose for which they have been advertised.

15. Intellectual Property: Theshowroomng.com has IP rights over the website including but not limited to diagrams, pictorial and artistic reproductions in it. Any reproduction of those works and diagrams are prohibited unless prior consent had been first sought and obtained from the IP right holders

16. Links and Third Party Websites: It is possible that theshowroomng.com may include links, which will lead to other Sites not connected to Theshowroomng.com. Theshowroomg.com does not bear liability for the measure and practices of the third party sites in relation to the collection and processing of data. Theshowroomng.com does not take responsibility for personal data disclosed by the User in chat rooms, forums, and other open areas where data will be freely accessible by third parties. If the User decides to visit these external links and websites, he/she does so at their own risk and Theshowroomng.com will not be responsible for any damage or loss resulting from opening such sites and links.

17. User Submission: Every information submitted by the User in the course of accessing the site e.g. names, address, e-mail, etc. are property of theshowroomng.com but will not be transferred or used, in accordance with the provision of the Data Guidelines 2017.

18. Amendment of the Terms/Conditions and other Contents of the Site: Theshowroomng.com reserves the right to unilaterally make amendments to these terms and conditions including any other contents of the website at any time without requiring the consent second or third party.
